Deaf and Mentally Ill Man Tasered by Mobile Police Sues City

MOBILE, Ala. -- Antonio Love, a deaf and mentally disabled man whom Mobile police forced from a Dollar General restroom wielding pepper spray and a Taser, sued Tuesday alleging that officers weren't properly trained and used excessive force to falsely arrest him.

 

The lawsuit in Mobile County Circuit Court seeks unspecified damages from the city of Mobile, police officers involved in the July 24 incident, Dollar General Corp., and a store manager.

Co-hosted by Birmingham magazine, Morris, Haynes & Hornsby, the Women Lawyers Section of the Birmingham Bar Association and Saks Fifth Avenue, the fashion show celebrated some of the women in leadership roles in the legal community and encouraged other professional women to donate their time, talents and gently used clothing to their “sisters” who are rebuilding their personal lives and careers with help from the YWCA.

Love Files $2M Claim Against Mobile

A $2,000,000.00 claim was filed today with the Mobile City Clerk in relation to the incident where a deaf and mentally challenged man was tasered at a Dollar General store. Birmingham attorney Tommy James of the firm Morris, Haynes & Hornsby represents Antonio Love, the deaf and mentally challenged man who was pepper-sprayed and tasered by Mobile police officers in the bathroom of a Dollar General store in Mobile. The incident occurred on July 24, 2009, at the Dollar General on Azalea Road. A notice of claim is required to be filed with the city clerk under Alabama law within six months of an incident when a city and its employees could potentially be defendants in a lawsuit.

The firm was honored in the September 11, 2009 edition of the Birmingham Business Journal as one of the Best Places to Work in Birmingham. Morris, Haynes & Hornsby employees at both the Birmingham and Alexander City offices completed workplace satisfaction surveys conducted by Quantum Workplace in order to qualify as a nominee one of Birmingham’s Best Places to Work 2009. The companies with the highest scores on the survey were selected as Best Places to Work.

Men are defined by their true character, moral fiber, and devotion to principles. Former Chief Justice Sonny Hornsby is top shelf. He holds to values and lives life for what it is. I recently had the opportunity to visit with him in his home. His company and conversation were most interesting and light. It felt more like I was having an afternoon conversation with a good friend than a man that has more connections than AT&T. His unassuming self confidence gives him the innate ability to be himself in any conversation.







Local Attorneys reached a $1 million settlement in a wrongful death case involving a wreck that claimed the life of a Dadeville woman.

 




Partners Larry Morris and Clay Hornsby were named by Alabama Super Lawyers magazine as two of the top attorneys in Alabama for 2009. Only five percent of the lawyers in the state are named by Super Lawyers. The selections for Super Lawyers are based on peer nominations and evaluations. Both attorneys were also named in the 2008 edition of Super Lawyers.

Two Jefferson County employees have filed lawsuits claiming they became seriously ill with Legionnaires' disease as a result of using a hot tub at an Oxford hotel. The lawsuit filed last week in Calhoun County Circuit Court, say the men became ill from a stay in 2008 at the former Wingate Inn. The hotel became the Fairfield Inn and Suites in April. The men's attorney, Todd Wheeles, said they were sent to the area to help clean up after a tornado stuck Heflin. Attempts by The Anniston Star to reach the hotel's owners were not successful.



A lawsuit seeks unspecified punitive and compensatory damages from the state Department of Mental Health, Mental Health commissioner John Houston and W.D. Parlow Developmental Center director Vance Liles in the Jan. 2nd death of a Partlow resident.



A lawsuit filed on behalf of Alabama residents contends Wal-Mart Stores Inc. CVS Caremark Corp., Rite-Aid Corp, and Walgreen Co. Inc., illegally filled prescriptions for brand names drugs with generic drugs without the prescribing doctor's permission.
