Plaintiff was operating his motorcycle in Conecuh County, Alabama when he was struck by a tractor trailer. Plaintiff’s wife, who was a passenger on the motorcycle, died at the scene from the injuries she sustained in the collision, while Plaintiff suffered a fractured shoulder. The Defendant driver of the tractor trailer owned the vehicle and was operating it in the line and scope of his employment with Performance Trucking, Inc. Plaintiff sued the Defendant driver and Performance Trucking for negligence, negligent hiring, and negligent training and supervision. Plaintiff received compensatory damages for the injuries he sustained, in addition to punitive damages for the death of his wife. Plaintiff also received underinsured motorist compensation from his own automobile liability carrier due to the Defendants’ inadequate liability coverage in light of the extreme negligence of the Defendants and severity of the injuries.
