Mr. Tullis Gore was killed in a predawn motor vehicle accident when he struck a tractor trailer that had been backed out of a driveway and parked on a rural highway, blocking both lanes of traffic. The Defendant argued that Mr. Gore was himself at fault because he had a line of sight of nearly one quarter mile. Mr. Gore’s view of the tractor trailer was obscured by heavy morning fog, the trailer’s angle, and the fact that the trailer had no running lights turned on.
