28 Dec Leyva Valdez v. Alpha Mail Carriers
This wrongful death claim arose out of a collision between an 18 wheeler owned and operated by ALPHA Mail Carriers. Although the collision occurred in Grand Junction, Colorado, the case was successfully brought in San Bernandino County due to the fact that the defendant truck driver and the plaintiffs were from California. The defendant truck driver collided into the rear of a vehicle operated by the parents of the plaintiffs. The impact forced the vehicle off the road. The parents were killed and another occupant was seriously injured. The collision occurred before sunrise. The defendant argued that the rear taillights of the Valdez vehicle were not working at the time of the collision. However, post accident testing confirmed that they were operational at the time of impact.
