08 Oct School Rape Case Survives Appellate Challenge; Successful Settlement
In a tragic case involving the rape of a seventh grade female student by a high school senior in the school gym during P.E. class while the coach who was supposed to be supervising the class was absent, the trial judge granted summary judgment based upon complex issues of state immunity. Tommy James, the attorney handling the case, appealed the decision, and won a reversal of the summary judgment, allowing the case to proceed. Upon return of the case to the circuit court, the case settled at mediation for an amount which may be the largest ever agreed to by the school insurer.
